Any information relating to any actual or proposed transaction which is provided to Nigerian Export-Import Bank by any person in connection with an enquiry regarding, or an application for Nigerian Export-Import Bank cover or support will be held in confidence by Nigerian Export-Import Bank.

However, for the purposes of responding to that enquiry or considering that application, Nigerian Export-Import Bank may disclose that information to any other government organization or to Nigerian Export-Import Bank's legal, financial or technical advisers; but will instruct such recipient to treat the information in confidence.

The foregoing shall be without prejudice to any obligation or duty which Nigerian Export-Import Bank might have to disclose information by law or as a matter of government policy.
